Terms and Conditions of Service – MCO Consultants Inc. eLearning Services
These Terms and Conditions (“Terms”) govern purchase of products from the MCO Consultants Inc.’s. (“Provider”, “we”, “us”, “our”) via www.mcoconsultants.ca (“Site”) eLearning Services. By purchasing, accessing, or using our eLearning services, you (“you”, “user”, “learner”, or “customer”) agree to be legally bound by these Terms. If you do not agree, do not use the Site.
- Definitions:
- “eLearning Services” means self-paced online courses, course bundles, digital learning materials, and related on-demand educational content delivered electronically through the Site.
- “Live Online Workshops” means instructor-led, scheduled virtual training sessions delivered in real time, whether standalone or bundled with other services.
- Eligibility and Jurisdiction
- You must be the age of majority in New Brunswick/territory to register or purchase a course.
- Residents of Canada and other jurisdictions may access our Site, but the laws of Canada and the Province of New Brunswick govern all matters.
- Account Registration and Security
- You must provide accurate, complete, and current information on registration and maintain security of your user account and password.
- You are responsible for all activity under your account and for promptly notifying us of any unauthorized activity.
- Course Licences and Access Rights
- Purchase of eLearning Services grants you a personal, non-exclusive, non-transferable, limited licence to access and use the content for your own learning.
- Sharing, transferring, or sublicensing your access or credentials is strictly prohibited.
- Access duration is as stated at purchase. “Lifetime access” means until the course is discontinued or the platform is operational.
- Access to Live Online Workshops is limited to the scheduled date(s) and does not include ongoing or recorded access unless explicitly stated at purchase.
- Payment, Pricing, Taxes, and Invoicing
- All fees are in Canadian dollars (CAD) unless otherwise stated and are subject to federal and provincial taxes (GST/HST/QST/PST) as applicable.
- Provider uses secure third-party payment processors compliant with PCI DSS (Payment Card Industry Data Security Standard).
- You authorize all charges and agree to pay all fees plus applicable taxes. Receipts and invoices are available in your account dashboard or via email on request.
- Subscriptions, Renewals, and Cancellations
- Subscriptions auto-renew unless cancelled prior to the next billing cycle by sending a written request to us via email: support@mcoconsultants.ca or using our Support Contact Us Form.
- You may cancel at any time, but there are no refunds for the remainder of a billing cycle unless required by law.
- Subscription fees are non-refundable once a billing cycle has commenced, except where required by applicable law or explicitly stated otherwise in writing.
- Subscription terms apply only to eLearning Services unless otherwise specified and do not apply to Live Online Workshops.
- Refunds and Consumer Protection
- Refunds are governed by applicable Canadian consumer protection laws, including the New Brunswick Consumer Product Warranty and Liability Act, the Business Practices Act (New Brunswick), and any other applicable federal or provincial legislation.
- If dissatisfaction, technical defects, or misleading advertising occur, you may be entitled to a refund in accordance with those laws.
- Our standard refund window is 14 calendar days from the date of purchase, subject to the eligibility conditions outlined in our Refund Policy, unless otherwise required by applicable law.
- Refund eligibility and timelines vary by service type and are set out in our Refund Policy, which forms part of these Terms. Different refund rules apply to eLearning Services and Live Online Workshops.
- Course Content and Intellectual Property
- All material—including videos, audio, text, PDFs, quizzes, and trademarks—are the exclusive property of MCO Consultants Inc. or our licensors, protected by Canadian copyright, trademark, and moral rights laws.
- Copying, selling, redistributing, uploading, or creating derivative works without written consent is prohibited.
- You may download materials only for your personal use, as permitted by the course.
- User Conduct, Accessibility, and Anti-Discrimination
- You agree not to harass, abuse, threaten, or discriminate against others in any course-related communications or on the Site.
- Our platform strives to be accessible per WCAG 2.1 guidelines; if you require accommodations, contact us for reasonable arrangements.
- We do not tolerate discrimination based on age, gender, race, ethnicity, disability, neurodiversity, sexual orientation, or any other protected ground.
- Technology, Privacy, and Data Protection
- Your personal information is collected, used, and stored in accordance with the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA), provincial privacy acts, and our Privacy Policy.
- By using the courses, you consent to data collection and to receiving course/service communications.
- We use cookies and analytics to improve functionality and user experience; you may set your browser to refuse cookies, though some features may not work.
- Service Interruptions and Technology Disclaimer
- We strive for continuous availability but do not guarantee uninterrupted access.
- We reserve the right to modify, suspend, or discontinue any course, feature, or part of the Site for maintenance, upgrades, or business reasons, with reasonable notice where possible.
- Live Online Workshops may be rescheduled or cancelled due to instructor availability, low enrollment, or unforeseen circumstances. In such cases, registrants will be offered a rescheduled session or refund, as outlined in the Refund Policy.
- Disclaimers and Limitations of Liability
- To the maximum extent permitted by Canadian law, all courses and content are provided “as is” for informational/educational purposes; no guarantee of completion or specific results, employment, or regulatory compliance is made unless explicitly stated.
- We disclaim all indirect, incidental, or consequential damages. Maximum aggregate liability is limited to the amount paid by you in the previous 12 months.
- Indemnity
- You agree to indemnify and hold harmless MCO Consultants Inc. and its agents for any loss, damage, or claim arising from your breach of these Terms or misuse of the Site.
- Modification of Terms
- We reserve the right to update these Terms at any time. Changes become effective upon posting to the Site. Significant changes will be communicated via email or prominent notice.
- Termination
- We may suspend/terminate your account for violation of these Terms, illegal conduct, or misuse of the Site or Services. You may terminate your account by contacting us.
- Suspension/termination does not limit our right to pursue legal remedies or recover damages.
- Dispute Resolution
- If you have a complaint, contact us first for a good-faith resolution.
- Most disputes must be resolved in the courts of New Brunswick, under Canadian law. For Quebec residents, disputes may be resolved under the Civil Code of Quebec as required by law.
- Either party may seek injunctive relief where intellectual property or misuse of confidential information is concerned.
- Entire Agreement
- These Terms, along with our Privacy Policy and any course-specific agreements, constitute the entire agreement between you and MCO Consultants Inc.
